Terms and conditions of sale

Article 1: General provisions

These General Terms and Conditions of Sale for the provision of services, hereinafter referred to as the GTC, constitute the agreement governing, during its term, the relations between the company Sud Chasse, hereinafter referred to as the Service Provider and its customers in the context of the sale of services.

In the absence of a contract concluded between the service provider and its client, the services provided are subject to the General Terms and Conditions described below. Any reservation made and any contract concluded with Sud Chasse imply the client's full and unconditional acceptance of these General Terms and Conditions. The fact that the service provider does not implement one or other clause established in its favor in these conditions cannot be interpreted as a waiver on its part to rely on them.

Article 2: Nature of services

The Sud Chasse company offers hunting days supervised by local guides or a professional guide referenced by the ACP. It searches for its clients open and communal territories as well as accommodation services but does not sell them. Sud Chasse also organizes tourist and cultural outings on request depending on the regions concerned.

The territories in which we hunt are reserved exclusively for our clients and Sud Chasse.

Article 3: Quote and reservation

The service provider intervenes at the express request of the client. The pricing conditions are those appearing on the document “prices and registration conditions”

After having read the pricing conditions, the customer must return the signed registration form accompanied by a deposit of an amount corresponding to the reserved hunting days, where applicable an amount set by Sud Chasse. A preliminary estimate will be drawn up, it sets in particular:

– The nature of the service

– The price of the service

– Payment terms

– The customer’s full and complete acceptance of the T&Cs

To confirm his reservation firmly and definitively, the client must return the signed quote without any modification or the registration form by post or by email, duly signed and dated with the words "Good for Agreement". The reservation will only be validated after return of the accepted and signed quote or registration form, accompanied by the payment of a deposit corresponding to the number of days of hunting reserved. The shooting tax(es) will be paid at the end of the stay and according to the result of the hunt.

Validation of the reservation implies the customer's full and complete acceptance of these General Terms and Conditions without reservation.

Article 4: Special provisions

Any animal that is injured and not found is considered lost and will be billed at its value according to the price list, Sud Chasse is in contact with the departmental delegates of the UNUCR and will organize a blood search to try to find the injured animal. For mountain hunting, if the hunter has been put in a shooting situation twice on game stopped less than 200 meters away and the animal is not shot, Sud Chasse reserves the right to charge 50% of the shooting tax corresponding to the game shot.

Article 5: Payment terms

Invoices are payable upon receipt, less the deposit if applicable. Payment is made by check, bank transfer, or in cash if applicable. No discount will be granted for early payment. Payment for services will be made immediately after the end of the stay to the manager or their representative. Depending on the case, payment may be made after sending the invoice by return mail and without delay. Please note, bracelets are sold at cost price.

Article 6: Late payment

Any delay or failure to pay will automatically result in:

– The immediate payment of any amount remaining due,

– The calculation and payment of a late payment penalty in the form of interest at a rate equivalent to three times the legal interest rate (in force on the day the services are invoiced). This penalty is calculated on the amount excluding tax of the sum remaining due, and runs from the day following the payment date shown on the invoice, until its full payment, without any prior reminder or formal notice being necessary. The applicable rate is calculated pro rata-temporis.

Article 7: Cancellation

If the customer is obliged to cancel his stay, he must inform Sud Chasse by registered letter with acknowledgement of receipt, the date of acknowledgement of receipt being retained as the cancellation date for the invoicing of cancellation fees. Cancellation fees are calculated as follows: Cancellation between the 45th and 30th day: deduction of 25 % of the price of the stay; Cancellation between the 29th day and the day before the stay: deduction of 50 % of the price of the stay corresponding to the deposit paid when booking; Cancellation on the day of departure: deduction of 100 % of the total price of the stay. In the event that the participant has taken out a cancellation insurance policy, the insurance guarantee would cover the payment of the cancellation fees less the cancellation insurance costs.

In the event of force majeure, the manager will study the case and propose a suitable solution.

Article 8: Guarantees

Since hunting is practiced on open territories and on totally wild game, Sud Chasse cannot guarantee any trophy or picture. Indeed, various factors independent of the organizer can influence the result of the hunts, such as weather conditions, allocations of the hunting plan, etc. However, our experience of this type of stay will allow you to fully satisfy your wishes.

Article 9: Obligations and Confidentiality

Sud Chasse undertakes to:

– Respect the terms of the contract and the services for which he has committed.

– Do everything possible to ensure that the stay is a complete satisfaction

The customer agrees to:

– Comply with the instructions given by your guide and in accordance with the established reservation.

– Respect all service providers who receive it: guides, hosts, escorts.

– Do not attempt to appropriate by any means whatsoever the territories on which he hunts under penalty of immediate and definitive exclusion.

– Present yourself with a weapon(s) adapted to the game and the hunting method and adjusted for shooting at 200 meters.

Article 10: Civil Liability

Each hunter must present himself with a hunting permit validated for the current season and for the department concerned. He must also have taken out compulsory liability insurance. Sud Chasse cannot be held responsible for any damage that may be caused during stays. On simple request we can help you in the process of obtaining validation of the permit, just ask us.

Article 11: Disputes

These General Terms and Conditions and the contract signed between the parties are governed by French law. In the absence of an amicable resolution, any dispute persisting between the parties regarding the execution or interpretation of the General Terms and Conditions and the contract will be subject to the jurisdiction of the courts of Auch.
